The Supreme Court ruled 6-3 in Fischer v. US to reverse the DC Circuit’s decision, which had adopted a broader reading of the law to allow charges against Fischer and other January 6, 2021, defendants to go forward.
Chief Justice John Roberts wrote the Court’s opinion, ruling that the government could not use a provision of the 2002 Sarbanes-Oxley Act against Fischer and other J6 defendants. This is a major win for those who trespassed at the Capitol on January 6, 2021, and were saddled with charges well beyond what their actions warranted. Roberts was joined by Justices Clarence Thomas, Samuel Alito, Neil Gorsuch, Brett Kavanagh, and Ketanji Jackson, in an atypical mix. Justice Jackson wrote a concurrence. Justice Amy Barrett wrote in dissent, joined by Justices Sonia Sotomayor and Elena Kagan.
