The United States Supreme Court, today, June 14, overturned Donald Trump’s bump stock ban. The vote at the court was 6-3. Justice Clarence Thomas wrote the opinion for the court, joined by Chief Justice John Roberts and Justices Samuel Alito, Neil Gorsuch, Brett Kavanaugh, and Amy Barrett. Alito filed a separate concurring opinion while Justice Sonia Sotomayor wrote in dissent, joined by Justices Elena Kagan and Ketanji Jackson.
In 2017, Trump directed the ATF to enact the ban following the massacre at the Mandalay Bay Hotel in Las Vegas. Gun rights proponents declared the act an unconstitutional power grab that created thousands of felons out of thin air without even legislative support.
“We hold that a semiautomatic rifle equipped with a bump stock is not a ‘machinegun’ because it cannot fire more than one shot ‘by a single function of the trigger.’ And, even if it could, it would not do so ‘automatically,'” Thomas wrote. “ATF therefore exceeded its statutory authority by issuing a Rule that classifies bump stocks as machineguns,” he said.
