303 Creative L.L.C. v. Elenis

Ruling in 303 Creative L.L.C. v. Elenis, on June 30, 2023, the majority opinion declared that “The First Amendment envisions the United States as a rich and complex place where all persons are free to think and speak as they wish, not as the government demands. Colorado cannot deny that promise consistent with the First Amendment.”

The question presented was:

“[W]hether [Colorado’s] course . . . to use its law to compel an individual to create speech she does not believe . . . violates the Free Speech Clause of the First Amendment.”
