(No Ratings Yet)During confirmation hearings, Senator Tom Coburn nailed Supreme Court nominee Elena Kegan with a zinger about the Commerce Clause in the U.S. Constitution. Realizing that Coburn was subtly referring to recently passed Health Care reform, in which American will be forced to health insurance, she couldn’t answer his question directly. Instead she mocked him and sidestepped the question.
The commerce clause {Article 1 Section 8} language reads:
Congress shall have power…to regulate commerce with foreign nations, and among the several states.
A cursory reading of the Federalist Papers and a basic understanding of 18th century economics makes it clear that the founders were referring to interstate tariff disputes, and in no way gives the federal government carte blanche authority to regulate anything it darn well pleases. If that were the case, why have a constitution in the first place?
Kagan is an elitist tyrant, which makes her the perfect pick for the Obama administration.
In questions of power, let no more be heard of confidence in man – but bind him down from mischief by the chains of the Constitution.
